Jme shopping terms
It's important to us that you get to order and enjoy our products with the minimum of fuss. As with everything in life there are some ground rules though, so please make sure that you read these terms and conditions carefully before ordering.
1. Information about Jme The Jme online shop is operated by Direct to Home limited, a company registered in England and Wales (No. 8301644) with its registered office at Weir Cottage, 2 Laindon Road, Billericay, Essex, CM12 9LD (VAT No. 151 5112 54) trading as Jamie at Home (Jamie at Home, "we" or "us"). These terms and conditions (of which the Security and Privacy Policy and the Shopping Help form part of) apply to all orders that you ("you" or "your") place using this website, www.jamieathome.com/shop ("the Website") for items ordered online.

2. Order process and registration2.1 When you place the order for your goods this is deemed to be an offer, and when we accept your order then this will form a contract between us. Acceptance will occur when the goods you have ordered are dispatched to the address you have given us.
2.2 When we process your order and have checked your card details and your address, we will take payment from your card. Goods are subject to availability. If we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given if you have already paid for the goods.
2.3 If you provide us with a correct e-mail address we will send you an order acknowledgement e-mail.
2.4 The applicable law are the laws of England and Wales.
Registration and Confidentiality2.5 You do not have to register in order to make a purchase. However, if you decide to register with us please ensure you do not give anyone else access to the account and keep your account username and password confidential and secure. You agree to accept sole responsibility for all activities that occur under your account or password. Please inform us immediately if you have any reason to believe that your username and/or password has become known to anyone else, or are being, or are likely to be, used in an unauthorised manner. Please ensure the details you provide us with on registration are correct and complete and inform us immediately of any changes to those details (e.g. change of email or postal address). You can access and update your registration details in the My Account section of the site, after logging in.
2.6 You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.
3. Pricing and PaymentPricing 3.1 Products are invoiced in GBP sterling at the price prevailing at the time you place your order and are not inclusive of delivery fees. Prices displayed on the Website include Value Added Tax (VAT) which will be charged at the current rate. If you are a non-EU customer, to reclaim VAT, you will need to contact the Jme customer care team at shop@jamieathome.com and request a VAT receipt and once it's received, contact HRM Customs and Excise. We do not have the facility to deduct or refund VAT ourselves. For delivery costs, please check out our delivery options.
3.2 Although we try to ensure that all prices on the Website are accurate, errors may occur. If we discover an error in the price of items you have ordered, we will contact you as soon as possible. You will have the option of either reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat your order in respect of the incorrectly priced item as cancelled.
3.3 Prices displayed on the Website apply to online purchases only. They are not indicative of the price of identical items purchased in any stores, at Jamie at Home parties or by any other means. We reserve the right to update prices displayed on the Website from time to time.
Payment3.4 You may pay for the items which you order online with most major credit cards and debit cards using our secure online checkout. We regret that we cannot accept cheques or cash as payment online.
3.5 When you place your order, our system automatically asks your card issuer for authorisation for this amount. If we get a valid authorisation, your card issuer will hold this value expecting a charge from us. Products are charged at dispatch and will appear as "Jamieathome.com"" on your statement.
3.6 If you wish to store your credit card details for future use you will need to complete our online registration (please see 2.5 and our Privacy policy about keeping your details secure). If you have 3D secure verification for your card, you may still need to provide a user name and password to complete your payment.
3.7 Please note that we cannot guarantee the security of any data sent by email. Accordingly, please do not send us payment information via email. For details of the security measures we employ, please read our Privacy Statement.
Gift Certificates3.8 Jamie at Home gift certificates can be used to purchase goods online. The full value of the voucher must be used within one transaction; no balance can be retained on the gift certificate. Change in the form of currency or credits to credit or debit cards cannot be provided. Gift certificates cannot be exchanged for cash. Multiple vouchers may not be used on one transaction. Vouchers are non-refundable.
3.9 When redeeming gift certificates online, you will be required to enter the voucher number into the voucher code field located within the virtual shopping basket. Lost or stolen gift certificates will not be refunded or replaced. Gift vouchers have a 12 month validity; they will expire one year from the date stated on the email on which they are sent.
3.10 If you return goods purchased with a gift certificate and where a refund is payable, we will issue you a new gift certificate by email by way of refund.

4.2 Please note that we are unable to deliver the following to Northern Ireland and non-Mainland UK: plants/gardening kits and other perishable goods. If item dimensions are small enough, they will be delivered through the letterbox. Otherwise, if nobody is available to accept delivery, a calling card will be left for you to re-arrange delivery or collection. Hampers may be shipped separately from other goods ordered.
International Delivery4.3 We deliver to many European countries. The cost of delivery will be added automatically to your order form when you select the country the goods are to be delivered to. Please click on the "delivery information" tab that's available on each product page for further delivery details.
We offer delivery to the EU countries listed here. Products available for UK delivery only will be noted within the product's description (including without limitation plants/gardening kits and other perishable goods).
4.4 A delivery charge of £10 applies to deliveries to the Republic of Ireland. A delivery charge of £25 applies to the following countries:

4.5 Please note that we are unable to deliver to PO boxes.
4.6 Import duties and taxes may have to be paid in some countries, for which you will be solely liable. Before ordering please obtain details of these charges from your local customs office in the country to which the goods are being dispatched. We cannot be held liable should local customs officials decide to hold or confiscate items for any reason, including where such items are not available for export to a particular country.
Delivery times4.7 We aim to deliver as specified above, but the delivery times above are for guidance and are not a guarantee. We cannot take responsibility for length of delivery time once an item is despatched from us to our carrier. A signature will be required to acknowledge delivery (where the parcel or package will not fit through the letterbox). Delivery may be attempted at a neighbour's house if no one is available to sign at the delivery address. The signature of the person accepting delivery at the delivery address will be proof that delivery has been received by you or the person to whom the order is addressed.
5. Cancellation5.1 If you wish to cancel your order, please contact our customer care team at shop@jamieathome.com or by telephone on 0845 279 7227 between 8.30am and 5pm Monday to Friday (10am to 5pm only on Wednesday). If we receive notice of your cancellation in time, prior to despatch, we will cancel the order and we will not debit your card. However, as we try to process orders immediately, it may not always be possible to prevent an order from being dispatched. If your order has already been dispatched, you may return the items to us in accordance with our Returns Policy below.
6. Returns and Refunds6.1 Returns for perishable goods (e.g. plants) and toiletries are accepted only if the goods are damaged or faulty and must be returned within 7 days from receipt. All other goods need to be returned within 28 days of receipt and in original, complete and undamaged packaging. If the item has not been returned to us in fully resalable condition, we reserve the right to refuse a refund on the item.
6.2 Please note any postage incurred by returning the item(s) to us will not be refunded nor will the original cost of delivery, unless in the case of damaged or faulty goods, or goods mistakenly shipped. For any broken glassware or ceramics, or in the case of damaged or faulty goods or items mistakenly shipped, please call our customer care team on 0845 279 7227 for advice.

6.4 We recommend using a registered postal service and retaining the proof of postage in case we do not receive the goods. We will not be responsible for returned goods being lost or damaged in transit.
6.5 We are happy to exchange or refund a product provided it is in fully resalable condition and returned to us within 28 days of receipt (unless faulty or damaged). Until you return items to us you are responsible for their safe keeping and taking reasonable care of them. We do not accept liability for returned packages damaged during transit back to us. It is your responsibility to wrap products adequately to prevent damage.
6.6 Exchanges will be sent out to addresses at the earliest availability. Refunds will be issued immediately on receipt of the item, subject to the item being refundable and our returns policy being met. Refunds will generally reach an account within 7 working days. Timings will, however, depend on the speed with which your credit/debit card company processes the credit. All refunds will be credited to the card originally used for the purchase, except where gift certificates were redeemed, in which case new gift certificates will be issued. You will be sent an email confirmation of your refund. When returning goods on which you have received a discount or special offer, that discount/offer will no longer apply and if you fall below the discount/offer threshold, the refund will be adjusted accordingly. Additionally, any free promotional gift issued with an order must also be returned if you are returning those goods.
6.7 None of the above terms affect your statutory rights when goods are faulty or incorrectly supplied nor does it affect your rights under the Consumer Protection (Distance Selling) Regulations.

8. General8.1 Certain goods are subject to age restrictions as indicated on the relevant web page. By placing your order for any of these goods, you confirm that you have reached the required age. To purchase products containing alcohol or knives on this Website, and lawfully enter into and form contracts on this Website, under English law you must be over 18 years of age. Warning: it is an offence to attempt to buy any product containing alcohol or knives if you are under age or to attempt to purchase one on behalf of someone else who is under age. All measurements are approximate. The reproduction of colours is as accurate as the photographic and production process will allow.
8.2 Except in relation to the description of products available for order from the Website, we do not guarantee and are not responsible for the accuracy of any information provided on the Website.

8.7 We do not represent or warrant that the material contained in the Jme Website, any of the functions of the Jme Website and the server will operate without interruption or delay or will be error-free, free from defects, viruses or bugs or compatible with any other software or material. The Jme Website is provided "as is". Accessing the Jme Website is entirely at your own risk.
8.8 You must not transmit through or to the Website any defamatory, threatening, obscene, distressing, harmful or pornographic material or material which may infringe upon the rights of others (including intellectual property rights, rights of confidentiality or rights of privacy) or which does not comply with all relevant laws.
8.9 The Jme Website and its content including all text, graphics, logos, button icons, images, data compilations and software used in connection with the Jme Website, is our property or that of our suppliers and is protected copyright, trade marks, database rights and other intellectual property rights.
8.10 The Jme Website may include links to third party web sites ("Third Party Site(s)") from time to time. You acknowledge and agree that we will not be responsible for the availability of such Third Party Sites and will not be responsible or liable for any content or services available from such Third Party Sites. You should check the privacy statements and terms and conditions of use of Third Party Sites accessible from this Website.
8.11 We will be responsible for any losses you suffer as a direct result of us breaching these terms and conditions if those losses were reasonably foreseeable to both you and us at the time the contract for the sale of items by us to you was formed (i.e. on dispatch of the order to the address you have given us). We will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions or the actions of our sub-contractors or agents, is consequential or was not reasonably foreseeable to both you and us when the contract between us was formed.
8.12 Our liability to you under these terms and conditions will not exceed the total price charged for the items purchased. Nothing in these terms and conditions excludes our liability to you for personal injury or death caused by our negligence.
8.13 We will not be responsible to you for any delay or failure to comply with our obligations under these terms and conditions if the delay or failure arises from any cause beyond our reasonable control.
8.14 We reserve the right at any time to make changes to this Website, these terms and conditions, our Security and Privacy Policy, the FAQs and such other policies as we may notify you of. You will be subject to the policies and terms and conditions in force at the time you use the Website or order items from the Website. Changes which we are required to make by law could apply to orders which you have already made. If any of the terms and conditions forming the contract between us are deemed invalid, void or unenforceable for any reason, it will be deemed severable and not affect the validity and enforceability of the remaining terms and conditions.
8.15 If you breach these terms and conditions and we take no action we will still be entitled to use our rights and remedies in other situations where you are in breach.
8.16 You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these terms and conditions by you or any other liabilities arising out of your use of the Website, or the use by any other person accessing the Website using your shopping account and/or your personal information.
8.17 All matters concerning and incidental to any offer or agreement for the purchase and sale of goods from the Website shall be in English and construed and governed according to English law and the English courts shall have exclusive jurisdiction in all such matters.
